The purpose of the Antarctic Environmental Protection Act (AEPA) is to protect the Antarctic environment by implementing the Protocol on Environmental Protection to the Antarctic Treaty. The AEPA provides the legislative basis that Canada requires to oversee Canadian activities in the Antarctic and otherwise fulfill the Madrid Protocol's obligations. Germany adopted the attached national law to implement the obligations arising from Annex VI to the Protocol on Environmental Protection to the Antarctic Treaty on 5 July 2017. The national law defines the scope of its application (enumerating all activities which could be connected to a relevant environmental emergency) (§ 1). It further defines relevant terminology (§ 2). Further, it sets forth the obligations of operators of relevant activities (§§ 3-6). These obligations include preventive measures, contingency plans and the immediate notification of environmental emergencies. The national law further contains rules on liability, on liability in connection with response actions, on the limits of liability and on financial security (§§ 7 -13). Furthermore, there are rules on procedure, including on recourse to the courts (§§ 14-16). Finally, the law contains penalty and penal provisions (§§ 17-18). It ends with a provision concerning the entry into force (§ 19). The national law has not yet entered into force, but will enter into force on the day that Annex VI enters into force (01.01.2021 is just a wildcard). (View Details)

The Rules contain various sections about environmental conservation, Permit application form, fee structure, post-visit report format, and emission standards /permissible and wastewater discharge standards from the station activities, equipment, and vehicles Two session courts: (a) Bombay High Court Bench at Goa and (b) Delhi High Court, New Delhi, are designated as courts of sessions to deal with offenses against the provisions of the Act and to impose punishment and penalties. Two Inspectors (domestic) are designated under the Act and Rules to inspect the samples and other material, facilities, etc., while it is brought back to India from Antarctica. (View Details)

In Japan, the Law relating to Protection of the Environment in Antarctica (Antarctic Environment Law) entered into force on 14th January 1998, on the same day when the Protocol itself entered into force. Since then, Japan has worked for the implementation of the Protocol through the Antarctic Environment Law. According to the Antarctic Environment Law, in principle, no person shall engage in any activity in Antarctica other than Antarctic Activity Plan that has been certified by the Minister of the Environment, Japan. The Government of Japan issues and distributes pamphlets, and set up website to provide Japanese citizens of information on natural features, legal procedures required to visit Antarctica, the history of Japanese Antarctic Research and alike. The Act on Antarctic Activities and Antarctic Environmental Protection was enacted in 2004 (amended on March 31, 2020), following the adoption of the Protocol on Environmental Protection to the Antarctic Treaty, for the purpose of promoting our active participation in the Antarctic environmental protection regime. This Act provides for the protection of the Antarctic environment, permission for activities within the Antarctic Treaty area, permission for the capture of native animals or collection of native plants, permission for entry into Antarctic Specially Protected and Managed Areas, regular and effective monitoring, and designation of an Antarctic Inspector. This note explains how Annex VI to the Protocol on Environmental Protection to the Antarctic Treaty (the “Liability Annex”) will be implemented in New Zealand law, through the Antarctica (Environmental Protection) Act. A link to the Amendment Act referenced in the Note is included below. It is not yet in force. El Estado peruano es Parte del Tratado Antártico desde el 10 de abril de 1981, fecha de su adhesión al citado instrumento internacional; por esta razón formuló y promulgó, por primera vez, su Política Nacional Antártica mediante el Decreto Supremo Nro. 009-87/RE de 07 de octubre de 1987. Al haberse constituido como Parte Consultiva en 1989 y considerando la evolución del Sistema del Tratado Antártico, así como los logros y experiencias adquiridos por el Perú a lo largo de sus Expediciones Científicas, dicha Política Nacional tuvo que ser actualizada, aprobándose a través del Decreto Supremo Nro. 010-2002-RE de 27 de febrero de 2002 un nuevo texto de Política Nacional Antártica. Transcurridos 12 años y considerando el actual escenario internacional y los desafíos que afronta la Antártida, se actualizó Política Nacional Antártica mediante Decreto Supremo Nro. 014-2014-RE de 29 de marzo de 2014, la misma que se anexa. The Venezuelan Antarctic Program (PAV) is fundamentally managed in two well-defined scenarios: The Antarctic Presidential Commission and the Center for Oceanology and Antarctic Studies of the Venezuelan Institute for Scientific Research (COEA-IVIC). The Antarctic Presidential Commission, established by means of Official Gazette No.5.802, dated January 8, 2008, is assigned to the Vice-presidency of the Republic and it is coordinated by the Ministry of People’s Power for University Education, Science and Technology. Regarding its goals, it is important to highlight the commitment to provide direct advice to the Executive in the decision-making process for everything related to the Antarctic topics. As it is stated in the Official Gazette, the national bodies and institutions that constitute the Presidential Antarctic Commission are the following: 1. Ministry of People's Power for Science and Technology; 2. Ministry of People's Power for Defense; 3. Ministry of People's Power for the Environment; 4. Ministry of People's Power for Energy and Petroleum; 5. Ministry of People's Power for Planning and Development; 6. Ministry of People's Power for Foreign Affairs; 7. Universities and Institutes dedicated to research in this area; On December 19th, 2011, by means of PAV-019-12 official document, the Minister of People's Power for Science and Technology created the Center for Oceanology and Antarctic Studies of the Venezuelan Institute for Scientific Research (COEA-IVIC); in order to coordinate all Venezuelan Antarctic activities, both scientific and logistic.
